TERMS OF USE

1. ACCEPTANCE OF TERMS

Cotswold Grapevine provides a collection of online resources, including classified ads, forums, directories, and various email services available on or through Cotswold Grapevine (referred to hereafter as “the Service”) subject to the following Terms of Use (“TOU”). By using the Service in any way, you are agreeing to comply with the TOU. In addition, when using particular Cotswold Grapevine services, you agree to abide by any applicable posted guidelines for all Cotswold Grapevine services, which may change from time to time. Should you object to any term or condition of the TOU, any guidelines, or any subsequent modifications thereto or become dissatisfied with the Service in any way, your only recourse is to immediately discontinue use of the Service.  

2. MODIFICATIONS TO THIS AGREEMENT  



We reserve the right, at our sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such modifications shall become effective immediately upon the posting thereof. You must review this agreement on a regular basis to keep yourself apprised of any changes.  

3. ELIGIBILITY FOR USE

Cotswold Grapevine reserves some parts of the Service exclusively for professional purchasers, sellers, trade members, collectors and resellers of items and accessories who are acceptable to Cotswold Grapevine in its sole discretion. Although Cotswold Grapevine attempts to limit the use of these parts of the Service to such users, nothing herein shall create any right of action against Cotswold Grapevine for failing to adequately screen potential users or prevent the use of Cotswold Grapevine or the Service by unauthorised users.  

4. CONTENT

You understand that all advertisements, postings, messages, text, files, images, photos, video, sounds, or other materials (“Content”) posted on, transmitted through, or linked from the Service are the sole responsibility of the person from whom such Content originated. More specifically, you are entirely responsible for each individual item of Content that you post, email or otherwise make available via the Service. Likewise, if you request the assistance of Cotswold Grapevine to post content, or if you imply consent that Cotswold Grapevine may post content on your behalf, either by written or oral means, or you fail to inform Cotswold Grapevine that content should be removed, you are equally responsible for the content.  

You waive any and all claims against Cotswold Grapevine of a right of publicity for your image or likeness throughout the world by posting any information or pictures of yourself on Cotswold Grapevine. You understand that Cotswold Grapevine does not control, and is not responsible for personal Content made available through the Service, and that by using the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable.  

By posting Content to any part of the Service, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide licence (with the right to sublicence) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such Content for any purpose on or in connection with the Service or the promotion thereof. Furthermore, Content available through the Service may contain links to other third-party websites. Following links to any other websites is entirely at your own risk. You acknowledge that Cotswold Grapevine does not pre-screen or approve Content, but that Cotswold Grapevine shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any Content that is available via the Service.  

5. THIRD PARTY CONTENT, SITES, AND SERVICES

Cotswold Grapevine and Content available through the Service may contain features and functionalities that link you or provide you with access to third-party content independent of Cotswold Grapevine, including websites, directories, accommodation providers, tour operators, and local businesses. Your interactions with organisations, businesses, and/or individuals found on or through the Service, including payment and delivery of goods, accommodation, tours, or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organisations or individuals.  

We do not guarantee the quality, safety, roadworthiness, or legality of any Content, motorcycle parts, gear, vehicles, accommodation, or services offered for sale or advertised. Buyers and members should assume that any second-hand goods offered on classifieds are not new and may require inspection prior to use. It is not possible for Cotswold Grapevine to verify information provided by sellers or listed businesses.  

You agree that Cotswold Grapevine shall not be responsible or liable for any loss or damage of any sort incurred as the result of any dealings between users of the Service. In the event that you have a dispute with one or more other users or businesses, you hereby forever release Cotswold Grapevine, its officers, employees, agents, and successors from claims, demands, and damages (actual and consequential) of every kind or nature, known or unknown, arising out of or in any way related to such disputes.  

6. NOTIFICATION OF CLAIMS OF INFRINGEMENT

If you believe that your intellectual property rights have been violated, please send your notice (“Notice”) to Cotswold Grapevine’s agent at:

Please include: (a) Identification of the infringing material; (b) A statement of good faith belief that the use is unauthorised; (c) Your contact information; and (d) A declaration that the information provided is accurate and that you are authorised to act on behalf of the owner.  

7. PRIVACY AND DATA PROTECTION

Cotswold Grapevine preserves and processes personal data in accordance with UK Data Protection Legislation (including the UK GDPR and Data Protection Act 2018). For details, please view our full Privacy Policy.

8. CONDUCT

You agree not to post, email, or otherwise make available Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, libellous, or invasive of another’s privacy.  

  • Harasses, degrades, or is hateful toward any individual or group on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.  

  • Violates applicable UK laws prohibiting discrimination in employment, housing, or commercial practices.  

  • Impersonates any person or entity or misrepresents your affiliation.  

  • Includes personal or identifying information about another person without their explicit written consent.  

  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights.  

  • Constitutes unsolicited commercial advertisements, "junk mail," "spam," or affiliate schemes.  

  • Advertises any illegal service, stolen goods, or the sale of items prohibited under UK law.  

  • Contains software viruses or code designed to interrupt or damage computer hardware or software.  

Additionally, you agree not to:

  • Contact anyone who has asked not to be contacted.  

  • Stalk or harass any member.  

  • Collect personal data about other users for commercial or unlawful purposes.  

  • Use automated scrapers, spiders, robots, or crawlers to extract data without written consent.  

  • Attempt to gain unauthorised access to Cotswold Grapevine’s computer systems or disrupt the Service.  

9. POSTING AGENTS

You may not use a "Posting Agent" or automated third-party tool to post Content to the Service without express written permission from Cotswold Grapevine.  

10. NO SPAM POLICY

Sending unsolicited email advertisements to Cotswold Grapevine email addresses or through our systems is strictly prohibited. Unauthorised use of our computer systems constitutes a breach of these TOU and a violation of the UK Computer Misuse Act 1990.  

11. PAID POSTINGS AND SUBSCRIPTIONS

We may charge fees to access certain features or post in designated areas. Fees are paid upfront and are non-refundable once the digital service or listing has been published or accessed, except where required under UK Consumer Rights legislation. Subscriptions automatically renew at the specified interval unless cancelled prior to the renewal date via your member dashboard.  

12. LIMITATIONS ON SERVICE

You acknowledge that Cotswold Grapevine may establish usage limits, including storage duration for postings, maximum file sizes, and access frequency. Cotswold Grapevine reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without liability.  

13. ACCESS TO THE SERVICE

Cotswold Grapevine grants you a limited, revocable, non-exclusive licence to access the Service for personal use. Scraping, aggregating, or duplicating site content for commercial purposes without prior written authorisation is strictly prohibited.  

14. TERMINATION OF SERVICE

You agree that Cotswold Grapevine has the right in its sole discretion to deactivate your account, block your IP address, or terminate your access to the Service immediately and without notice if we believe you have violated these TOU.  

15. PROPRIETARY RIGHTS

The Service and its contents are protected by UK copyright laws and international treaties. You agree not to reproduce, duplicate, copy, or sell any portion of the Service or its underlying code.  

16. DISCLAIMER OF WARRANTIES

YOU AGREE THAT USE OF Cotswold Grapevine IS ENTIRELY AT YOUR OWN RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY UK LAW, Cotswold Grapevine DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, SECURITY, AND NON-INFRINGEMENT.  

17. LIMITATIONS OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, Cotswold Grapevine SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE, OR FROM ANY GOODS, SERVICES, ACCOMMODATION, TOURS, OR DISCOUNTS OBTAINED THROUGH THE SERVICE. NOTHING IN THESE TERMS SHALL LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER ENGLISH LAW.  

18. INDEMNITY

You agree to indemnify and hold harmless Cotswold Grapevine, its operators, officers, directors, agents, and partners from any claim, loss, liability, or legal expenses (including legal fees) made by any third party arising out of your Content, your breach of these TOU, or your violation of any third-party rights.  

19. GOVERNING LAW AND JURISDICTION

These Terms of Use, their subject matter, and their formation are governed by the laws of England and Wales. You and Cotswold Grapevine both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising out of or in connection with the Service. If any provision of these TOU is found invalid by a court, the remaining provisions shall remain in full force and effect.  

20. VIOLATION OF TERMS AND REMEDIES

If you breach these TOU by spamming, scraping data, running unauthorised automated posting scripts, or harvesting user data, you acknowledge that you have caused damage to Cotswold Grapevine and we reserve the right to seek civil remedies, injunctions, and full recovery of costs and damages incurred through legal proceedings in the English courts.

21. MOTORCYCLE EVENTS, ROUTES, AND RIDING DISCLAIMER

Participating in motorcycle rideouts, charity events, green lane riding, or following route guides published on Cotswold Grapevine involves inherent physical risks. You are solely responsible for ensuring that your motorcycle is fully taxed, insured, MOT’d, and road-legal in the UK, and that you hold a valid driving licence.

Cotswold Grapevine accepts no liability for road traffic accidents, personal injury, property damage, vehicle failure, traffic fines, or loss incurred while attending events, riding published routes, or interacting with other members offline. You participate in all rides and events strictly at your own risk.

22. BRAND & LISTING AGREEMENT FOR BUSINESSES

By creating a business profile or claiming a listing on Cotswold Grapevine, you confirm that you have full legal authority to represent the business, its logos, pricing, and services. You grant Cotswold Grapevine a licence to display your submitted images, logos, and business details across the directory and connected promotional channels. Cotswold Grapevine reserves full discretion regarding listing placement and visibility.
